The Exotics On Cannery Row vehicle registration fee is $125. This registration fee includes a reserved spot along Cannery Row and the ability to showcase your car during the EOCR event.

RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
EOCR - Exotics On Cannery Row is an event owned by Exotics On Cannery Row LLC., a California State Corporation. Exotics On Cannery Row in Monterey, California • August 19, 2016

IN CONSIDERATION of being accepted to participate as a Registered Show Car Participant in the Exotics On Cannery Row, hereby referred to as EOCR, (held at Cannery Row, California or such other location as is selected by EOCR). The Participant, for himself, his personal representatives, heirs, successors and assigns, as well as the Participant’s owners, officers, heirs and affiliates acknowledges, agrees and represents that:

THE PARTICIPANT HEREBY accepts the risks inherent in the event and hereby agrees to release Exotics On Cannery Row, LLC., its owners and affiliates, Other Event Registrants, the venue or such other location as is selected by EOCR, the venue City, and all Partici- pating Clubs and any and all employees or contractors or their assigns from any loss, liability or damage caused to the Participant or to the Participant’s personal property, including claims for negligence, which arise out of the participation in or travel to the event at the venue or such other location as is selected by EOCR.

THE PARTICIPANT HEREBY agrees to save and hold harmless and indemnify Exotics On Cannery Row, LLC., its owners and affiliates, Other Event Participants, the venue or such other location as is selected by EOCR, the venue City, from all claims for loss, damage, cost, expense, fine or penalty, regardless of whether the same is also indemnified against by any other person, arising out of or in connec- tion with the Participant’s participation in or travel to the event at the venue, regardless of any omission or negligence of any Indem- nitee.

THE PARTICIPANT WARRANTS THAT Participant’s automotive liability and property insurance covers each vehicle that has been registered for the EOCR. The Participant understands that the Participant's vehicle insurance and liability insurance will be solely responsible for any property damage or liability claims that occur at the EOCR.

THE PARTICIPANT AGREES that any property damage to the venue or such other location as is selected by EOCR as a result of negli- gent behavior or intentional misconduct by the Participant will be the sole financial responsibility of the Participant.

THE PARTICIPANT further expressly agrees that the foregoing release, waiver, and indemnity agreement is to be as broad and inclusive as is permitted by the law of the State of California, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

THE PARTICIPANT HAS READ AND VOLUNTARILY SIGNED THE ‘SIGNATURE PAGE’ THAT ACCOMPANIES THIS RELEASE AND WAIVER, and further agrees that no oral representation, statement or inducement apart from the foregoing written agreement has been made. The parties agree that this agreement shall be interpreted in accordance with the laws of the State of California. Any dispute relating to or arising out of this agreement shall be submitted to binding arbitration with the American Arbitration Association, for hearing in California. A one and one half percent (1.5%) per month late fee will be assessed on any late amounts.

In event of default or non-payment the entire total value of contract will be due and payable immediately.

If dispute arises over a matter related to Participant’s participation in EOCR and the matter is referred to a collection agency or attorney, the substantially prevailing party shall be entitled to recover its reasonable attorney fees and collection fees.

EOCR Reserves the right to refuse service to anyone.

EXOTICS ON CANNERY ROW TERMS AND CONDITIONS

No advertising of any type will be allowed on vehicles. This includes stickers for rally, drives, parade, and concours. Any vehicle arriving with advertising will be turned away from the show without a refund. There are no exceptions to this rule. Except with previous permission from EOCR.

Cars must be clean! It is not necessary that your vehicle be in concours condition, however, it is a pre-requisite that your vehicle be free of dirt and other debris before entering the venue.

Exotics On Cannery Row does not assume any responsibility for loss at the event. Please be sure your insurance is in full effect.

Car Placement: Cars may place vehicles on August 19, 2016 between 2pm-4pm. Any Show vehicle that does not arrive on time will not be allowed to park in the event so make sure to allow yourself sufficient time. Participants agree to abide by all rules and regulations as promulgated by Exotics On Cannery Row, LLC. from time to time.
